By accessing our website, purchasing any service, or engaging with C Technologies, you ("Client," "Customer," "You") agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services .

1. Definitions
Term Definition
"Services" Brand strategy, visual identity design, digital marketing campaigns, SEO, paid ads management, website development, tech setup, and all related digital deliverables offered by C Technologies.
"Deliverables" Final work product including logos, brand guidelines, strategy documents, website files, marketing reports, analytics dashboards, and any other output specified in your project agreement.
"Project Agreement" The specific scope of work, timeline, and pricing agreed upon for a particular service (via invoice, proposal, or WooCommerce order).
"Personal Data" Any information relating to an identified or identifiable living individual, as defined under Jamaica's Data Protection Act, 2020 .

2. Acceptance of Terms
By placing an order through our WooCommerce store, submitting a contact form, or accepting an invoice from C Technologies, you acknowledge that:
1. You have read, understood, and agree to these Terms and Conditions

3. Services Overview
C Technologies offers digital services across four core areas:
1. Brand Strategy — Positioning, audience research, brand voice, messaging frameworks
2. Visual Identity — Logo design, color systems, typography, brand guidelines
3. Digital Marketing — Social media management, paid ads (Meta/Google), SEO, email marketing, content marketing, WhatsApp marketing, reputation management
4. Website & Tech — Website design (WordPress, Webflow, Shopify), landing pages, UX/UI optimization, maintenance, analytics setup, CRM integration
Full service descriptions and pricing are available on our website. All services are digital deliverables — no physical products are shipped .

4. No Refunds & No Returns Policy
All sales are final. C Technologies does not offer refunds, returns, or exchanges on any digital services or deliverables.
This policy applies to all services including but not limited to strategy documents, logo designs, brand guidelines, website development, marketing campaigns, SEO work, and consulting sessions.
Limited exceptions (as detailed in our full [No Refunds & Returns Policy]) apply only if:
· C Technologies fails to commence work within the agreed timeframe with no communication
· Duplicate payment occurs in error
By purchasing from C Technologies, you waive any right to a refund or chargeback except under the limited exceptions above. Chargebacks filed for legitimate purchases will be disputed with full documentation of this agreement .

5. Payment Terms
5.1 Accepted Payment Methods
We accept payments via:
· Credit/Debit cards (via Stripe)
· PayPal
· Direct bank transfer (Jamaican local banks)

5.2 Payment Schedules
· One-time projects: 100% payment required before work commences
· Monthly retainers: First month's payment due before work begins; subsequent payments due on the same date each month
· Payment plans (where offered): As specified in your Project Agreement
5.3 Late Payments
If payment is not received within 7 days of the due date:
· We reserve the right to pause all active services
· A late fee of 5% of the outstanding amount may be applied
· Services will resume only after full payment (including late fees) is received
5.4 Taxes
Prices displayed on our website do not include General Consumption Tax (GCT). If C Technologies is required to charge GCT (upon registration with TAJ), it will be added at checkout at the standard rate of 15% . Currently, C Technologies is not GCT-registered until revenue exceeds JMD $15,000,000 annually.

6. Delivery and Timelines
6.1 Estimated Timeframes
Delivery estimates provided in project agreements or on product pages are estimates only. While we strive to meet all deadlines, C Technologies is not liable for delays caused by:
· Client late responses or missing information
· Technical issues beyond our control
· Force majeure events (natural disasters, internet outages, etc.)
6.2 Client Responsibilities
To avoid delays, you agree to:
· Provide requested assets (logos, copy, images) within 3 business days of request
· Respond to approval requests within 5 business days
· Designate a single point of contact for feedback
If you fail to respond for 30 consecutive days, we reserve the right to close the project. No refund will be issued.
6.3 Delivery Method
Deliverables are provided digitally via:
· Email attachment
· Cloud storage link (Google Drive, Dropbox, WeTransfer)
· Direct access to developed website (credentials provided)

7. Revisions and Approvals
7.1 Revision Limits
Each service package includes a specified number of revision rounds (see product description):
· Basic packages: 2 revision rounds
· Standard packages: 3-4 revision rounds
· Premium packages: 5+ revision rounds
A "revision round" means one complete cycle of feedback submission and updated delivery.
7.2 Additional Revisions
Revisions beyond the included limit are billed at $50 USD per hour (or portion thereof).
7.3 Final Approval
You are responsible for reviewing all deliverables. Once you provide written approval (email or project management tool), the deliverable is considered final and accepted. Subsequent changes will be billed as new work.

8. Intellectual Property Rights
8.1 Ownership Upon Full Payment
Upon full and final payment for a service, C Technologies assigns to you all rights, title, and interest in the final deliverables (logos, brand guidelines, website code, etc.), subject to the exceptions below.
8.2 What We Retain
C Technologies retains ownership of:
· Pre-existing materials: Any templates, code libraries, fonts, stock assets, or tools we used (licensed to you for use within your deliverables)
· Portfolio rights: The right to display your deliverables in our portfolio, website, and social media (unless you request confidentiality in writing)
· Internal tools: Processes, methodologies, and proprietary systems
8.3 Third-Party Assets
Any third-party assets (fonts, stock images, plugins) provided to you are subject to their original licenses. We will inform you of any usage restrictions.
8.4 Your Materials
You retain ownership of all materials you provide to us (logos, copy, images). You grant us a license to use these materials solely for the purpose of completing your project.

9. Client Warranties and Obligations
You warrant that:
1. You have the legal right to use any content, trademarks, or materials you provide to us
2. Your materials do not infringe on any third-party intellectual property rights
3. You will not use our deliverables for any illegal purpose under Jamaican law

10. Limitation of Liability
To the maximum extent permitted by Jamaican law:
1. C Technologies is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website
2. Our total liability to you for any claim (whether in contract, tort, or otherwise) is limited to the total amount you paid to C Technologies in the 6 months preceding the claim
3. We do not guarantee specific results from our digital marketing services (e.g., sales, website traffic, conversion rates). Marketing outcomes depend on many factors beyond our control including market conditions, competition, and your product quality.
4. Website and tech services: While we take reasonable security measures, we cannot guarantee that any website is completely immune to hacking, data breaches, or technical failures.

11. Disclaimer of Warranties
Services are provided "AS IS" and "AS AVAILABLE" .
To the fullest extent permitted by Jamaican law, C Technologies disclaims all warranties, express or implied, including:
· Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
· Warranties that our services will be uninterrupted, error-free, or completely secure
Jurisdictional note: Under Jamaica's Consumer Protection Act, certain implied warranties (such as the right to goods/services of acceptable quality) cannot be excluded for consumers. 13. Termination
13.1 By C Technologies
We may terminate our agreement and suspend services immediately if:
· You breach any material term of these Terms and Conditions
· Your payment is more than 14 days overdue
· You become insolvent or enter liquidation
13.2 By You
You may terminate a recurring service (monthly retainer) by providing 30 days' written notice. No refund will be issued for the current month.
13.3 Effect of Termination
Upon termination:
· You must pay all outstanding fees up to the termination date
· We will deliver any completed, unpaid-for deliverables upon full payment
· Sections governing intellectual property, limitation of liability, and indemnification survive termination

14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Jamaica .
14.2 Dispute Resolution Process
Step 1 — Good Faith Negotiation: Any dispute shall first be attempted to be resolved through good faith discussions within 14 days.
Step 2 — Mediation: If not resolved, the parties agree to submit to mediation at the Dispute Resolution Foundation of Jamaica before commencing any legal proceedings.
Step 3 — Arbitration or Court: If mediation fails, the dispute shall be resolved by binding arbitration in Kingston, Jamaica, in accordance with the Arbitration Act of Jamaica. Either party may instead elect to bring a claim in the Parish Court for Ocho Rios if the claim value is within its monetary jurisdiction.
14.3 No Class Actions
All disputes must be brought on an individual basis. You waive the right to participate in any class action or consolidated proceeding against C Technologies.

15. Changes to These Terms
